Welcome to ANAMATA, a multi-messaging and transactional platform that enables experts (or “Sellers”) of all kinds to engage with and get paid by their customers (or “Buyers”).The Terms of Use of ANAMATA ("Terms") govern the relationship between ANAMATA Inc ("Company", "we") and internet users who have accessed ANAMATA ("users", "you").You may use ANAMATA in accordance with the provisions of the Terms and Privacy Policy. If you do not agree with them, you must stop using ANAMATA.

1. What is ANAMATA

ANAMATA provides a tailored experience that enhances Sellers' chances of connecting with Buyers in search of their services. The platform can be utilized to discover, propose, and acquire services offered by Sellers. Unless specifically mentioned in this Agreement, ANAMATA does not serve as a representative for either Sellers or Buyers.

2. Signing Up to ANAMATA

You can Sign Up to ANAMATA using your mobile phone number or via your social network profile provided in the ANAMATA login form. After signing up, we will create your unique profile. You can only have one profile on ANAMATA at a time linked to one phone number.

If you Signing Up to ANAMATA via a social network, certain features will be limited to you. To access all of the features of the service, we may ask you to provide your phone number or/and email address or to be verified via your post address.

By signing up to ANAMATA and each time you Sign In to ANAMATA, you warrant that you have all the authority necessary to enter into and perform the Terms.

3. Signing In to ANAMATA

You can Sign In to your ANAMATA profile (login) either by using the mobile phone number/email address indicated in your profile or by using the social network associated with your profile («login details»). In the first case, you need to enter your password, in the second case you need to pre-authorize in the relevant social network.

You are obliged to keep your ANAMATA login data confidential. If you have reason to believe that someone has gained unauthorized access, please notify us immediately. Any actions performed on ANAMATA by anyone authorized using your login credentials will be presumed to have been committed by you. You will be responsible for such actions.

4. Information about users

The information you provide to the Company about yourself must be accurate, up-to-date and must not violate the law or the rights of third parties. You must update them as necessary in your ANAMATA profile.

We cannot guarantee that all information provided by users on ANAMATA is accurate. Please exercise caution when engaging in transactions.

In some cases, we may ask you to submit to a security check, or allow you to do so on your own initiative.

The security check is required to honor your contract and protect the safety of ANAMATA users as we strive to provide a service that makes it easier for users to trust each other and complete transactions.

The provision of the user's information is intended to confirm the following facts: 1) the user's profile was created by a real person for lawful use of ANAMATA and was not registered by automated means or was previously owned by another user but was hacked with the intent to commit unlawful actions; 2) the user is ready to provide additional information about himself/herself/themselves as he/she/them has no intention to commit unlawful actions (deceiving other users, illegally collecting contact data) and is not seeking to avoid any unlawful actions.

5. User content

User content — text and images that ANAMATA’s users post in the listings, the public part of the profile and reviews. By leaving feedback on sellers, as well as responses to reviews, you express your subjective opinion and evaluate your communication or transaction with another user.

The Company is not a distributor of user content. You own all the information you post on ANAMATA. You independently create, modify, post and delete content (including personal data) without our participation or consent.

If you disclose personal information as part of your public profile or listing so that users may contact you or obtain the most complete information about your offer, you disclose it yourself to an unspecified third party. The Company processes your personal data in order to fulfill the contract with you — the Terms of Use of ANAMATA.

If you disclose or otherwise provide personal data about third parties to the Company, you warrant to us that all applicable legal requirements regarding personal data have been met, including, but not limited to, ensuring the secure storage of such data and the necessary subject consents for such disclosure, transfer or access.

It is your responsibility to ensure that your user content is in full compliance with the law, the ANAMATA Terms of Use, posting rules, profile and feedback requirements. You warrant that your content does not infringe any third party's intellectual property rights.

ANAMATA does not pre-screen user content. We take action on content based on requests from authorized persons in the manner prescribed by law.

The purpose for which users post information on ANAMATA is to establish contact with a potential buyer who is interested in closing a deal regarding the product in the listing. It is forbidden to post knowingly false information in reviews, leave any feedback for sellers on ANAMATA, if you're not interested in striking a deal on the listings, and it's also not allowed to «cheat» reviews, including leaving reviews for a fee, which helps improve the seller's rating. User content may not be collected, copied, used or otherwise disposed of for purposes other than those set forth in the Terms. You may not use user phone numbers for purposes not directly related to the purchase of an item from the user.

You grant the Company the right to use your content and the intellectual property included in it on a non-exclusive license: perpetual, royalty-free, in any manner, for worldwide action, with or without naming the author. We may use your content to enforce the Terms, to improve ANAMATA, for advertising and educational purposes, in commercial and non-commercial projects. We may retain archived copies of user content and not remove from circulation materials that contain it.

6. Communicating with users on ANAMATA

Signed (authorized) users can write messages through the ANAMATA to discuss any questions and the terms of a transaction. You may not use messages for any other purpose, including transferring communication between users to other messengers or other communication channels by sending links to other sites, resources, and services on the Internet.

Messages to users for purposes not covered by the Terms violate the law on personal data and cause damage to the Company.

We may record, analyze and store messages made through the ANAMATA. Messages on ANAMATA are not personal. We have the right to selectively review correspondence to ensure compliance with the Terms of Use of ANAMATA and to make ANAMATA better.

8. Deleting a user profile

You have the right to delete your ANAMATA profile at any time by contacting support. Your profile will be deleted when you terminate the contract on the terms of the offer, if you signed it. We will delete your ANAMATA profile if you have not used it within three years.

For 30 days after deleting your profile, you will not be able to use the phone number you used in the deleted profile to Sign Up again.

We strive to make ANAMATA a convenient and safe tool, so we reserve the right to conduct random checks on users' compliance with ANAMATA’s Terms of Use at any time and at our discretion. We may use automated methods for this purpose.

We may take action if we detect any violations or acts of commission of violations of the law, third party rights or the Terms of Use, including but not limited to abuse of ANAMATA services using your profile or technical means: restrict access to your profile or any features of ANAMATA, for example, restrict access to ANAMATA messenges, restrict the display of your content in search results, hide the display of listings on the map, reject or block your content, limit access to ANAMATA from the bulk of your content, restrict access to ANAMATA from the public.

We may restrict access to a profile if other users have made complaints about it, if you have sent spam, if you have repeatedly or severely violated our Terms of Use, if you have hacked your profile, if you have not provided us with information as requested, if you have provided false reviews, if you have been liquidated as a legal entity, or if we have noticed conduct that constitutes fraud or imposition on your Account.

In exceptional cases, if the violations committed by the user have been fully remedied, we may restore access to the profile in order to maintain the loyalty of the ANAMATA user.

We shall not be liable for any damages incurred by users in connection with actions taken to prevent and terminate violations on ANAMATA. We recommend that you keep a backup copy of your content on your device.

You may be held administratively, criminally or civilly liable for violations of law or the rights of third parties when using ANAMATA.

11. Concluding Provisions

The provisions of Sections 2, 3, 6 — 8 of the Terms apply to users registered on ANAMATA. All other provisions apply to all users of ANAMATA regardless of registration and authorization. Any form of interaction with ANAMATA (including viewing information) confirms your acceptance of the Terms. The Company's obligation to provide access to the functionality of ANAMATA is reciprocal to your obligation to comply with the Terms. When there is no charge for the use of ANAMATA, consumer protection laws do not apply to the relationship between the Company and users. The provision of certain ANAMATA functionality may be subject to special terms and conditions.

The functionality of ANAMATA may be changed, supplemented or discontinued at any time without prior notice to users. The use of ANAMATA is offered in «as is» mode, i.e. in the form and to the extent that the Company provides the functionality of ANAMATA at the time of accessing it. We are not responsible for temporary failures and interruptions in the work of ANAMATA and the resulting loss of information. We shall not be liable for any indirect, incidental, unintentional damages, including loss of profits or lost data, damage to honor, dignity or business reputation caused by the use of ANAMATA. ANAMATA is intended for users in USA, so some functionality may be limited or unavailable outside USA.

ANAMATA may contain links to third-party sites. We do not control and are not responsible for the availability, content and legality of such third-party sites.

The legislation of the USA shall apply to the resolution of all disputes between the Company and users. All disputes shall be submitted to the court in accordance with the territorial jurisdiction at the location of the Company (Auckland), unless otherwise provided for by law.

We update the Terms of Use of ANAMATA as necessary. You are advised to periodically visit the page on which they are posted: anamata.io/terms-of-use.
